After an eight-day trial following a multi-year legal battle, an Arkansas jury ordered South Korea-based Hankook Tire Co. Ltd. to provide $1.2 million to the 76-year-old dump truck driver Elmer Philpot. Philpot suffered leg fractures that required hip replacement due to a tire tread defect.
According to court documents, Philpot was driving a truck that carried a load of gravel in 2010 when a faulty tread separated from his right front tire, causing him to lose control of the truck that he was driving. In the process, he veered from the roadway and got in his accident.
A Conway County jury sided with the prosecution, who argued Hankook was responsible for the crash. The defect in the tire and tread of Philpot’s truck originated at the truck’s production in Daejeon, South Korea. Philpot’s reward was the largest on record in the county.
