Following a 12-year malpractice case against University of Chicago Medical Center, a Cook County jury decided to grant $53 million to Lisa Ewing, the mother of a child born with severe cerebral palsy. According to the case, the negligent circumstances surrounding the birth of Ewing’s son, Isaiah, lead to the in utero hypoxia, or lack of oxygen, that caused Isaiah’s brain damage.
At the time of Isaiah’s birth, Ewing had to wait 12 hours in the hospital before a doctor came to see her. By the time her C-section occurred, the damage was enough to handicap the child severely.
As Ewing is a single mother, she is the sole person responsible for Isaiah’s care. The jury’s award includes a $28.8 million provision for Isaiah’s future caretaking, $2.7 million for lost future earning capacity, $346,000 for past medical expenses, and $7.2 million for his future medical expenses. “It’s a blessing to know that when I’m no longer here, he will be cared for,” Ewing said.
